Dampness Kills: The Numbers No One Wants to See

Why Do Landlords Do Nothing?
Landlord inaction in the face of moisture problems can be explained by several structural factors that we have analyzed:
The Cost of Works
Treating dampness in a home costs an average of €5,000 to €15,000. For a portfolio of 1,000 homes where 15% are affected, this represents €750,000 to €2.25 million. Many social landlords prefer to postpone these expenses.
Judicial Impunity
Only 3% of tenants who are victims of dampness initiate a legal procedure. Among them, less than half win their case. The legal risk remains low for negligent owners.
The Denial Strategy
68% of landlords blame tenants for "poor ventilation" or "excessive moisture production" (showers, drying clothes indoors). A rhetoric that allows them to avoid responsibility for structural defects.
Wearing Down Through Time
The average processing time for a request is 18 months. Many tenants end up moving before obtaining satisfaction, which "solves" the problem for the landlord without intervention.

Formal Notice
Send a registered letter with acknowledgment of receipt to your landlord. Cite Article 6 of the Law of July 6, 1989 and request an intervention within 15 days.
Conciliation Commission
Free and mandatory before any judicial action. Contact the CDC in your department. Response time: maximum 2 months.
ARS Reporting
In case of health danger (significant mold, children/vulnerable people), report to the Regional Health Agency. They can order mandatory works.
Legal Action
